Terms of Service

These Terms of Service ("Terms") govern your use of the RedevFund platform and related services operated by Rethela Technology Pvt Ltd ("RedevFund", "we", "us" or "our"). By accessing or using the platform you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Definitions

"Platform" means the RedevFund website, applications and related services. "User" means any person or entity accessing the Platform, including Developers and Resident Welfare Associations (RWAs). "Partners" means third-party financial institutions, NBFCs, private funders and escrow agents engaged through the Platform.

2. Services and scope

RedevFund provides a digital marketplace and coordination services that facilitate introductions and workflow between developers, RWAs and regulated financing/escrow partners. We do not directly provide loans, accept public deposits, act as a lender, nor underwrite loan facilities. All financial services are provided by our Partners and are subject to their separate terms, approval, and regulatory compliance.

3. Eligibility and account

You must be legally capable of entering contracts and authorised to act on behalf of any organisation you represent. You agree to provide accurate information when creating accounts and to keep credentials secure. You are responsible for activity that occurs under your account.

4. User obligations

• Provide accurate and complete documentation as requested by Partners.
• Comply with applicable laws, approvals and permissions for redevelopment projects.
• Not to use the Platform for unlawful activities or to misrepresent project facts.

5. Fees, quotes and partner terms

Any fees, interest rates, repayment schedules, security requirements and related lender terms will be provided by Partners. RedevFund may display indicative quotes but final terms are determined by Partners during underwriting. You agree that all financial arrangements are between you and the Partner and are subject to the Partner’s documentation and approvals.

6. Escrow and deposits

Where escrow or short-term deposit mechanisms are used, funds are held by regulated escrow agents or financial institutions engaged by the parties or Partners. RedevFund facilitates coordination; it does not itself hold or receive escrow funds except where specifically agreed in writing under a separate arrangement executed by a regulated entity.

7. Third-party services and links

The Platform may link to third-party websites and services. We do not control these parties and are not responsible for their content, terms, or practices. You should review partner terms and privacy policies before transacting.

8. Intellectual property

All intellectual property on the Platform is owned by RedevFund or licensed to it. You may not use our trademarks, logos or content without prior written permission.

9. Disclaimers and limitation of liability

The Platform and services are provided "as is" without warranties of any kind. To the fullest extent permitted by law, RedevFund and Rethela Technology Pvt Ltd exclude all liability for indirect, incidental, special, or consequential damages. Our aggregate liability for direct damages arising out of or in connection with these Terms is limited to INR 1,000 or the total fees paid to RedevFund in the prior 12 months, whichever is lower.

10. Indemnity

You agree to indemnify RedevFund and its officers, employees and Partners from any claims arising from your breach of these Terms, misuse of the Platform, or misrepresentations in your submissions.

11. Privacy and data protection

Our Privacy Policy governs how we collect, use, and disclose personal data. By using the Platform you consent to the collection and sharing of your information with Partners for the purposes of evaluation, underwriting, compliance, and transaction processing.

12. Termination

We may suspend or terminate accounts for breach of these Terms or for regulatory reasons. On termination, obligations that by their nature survive termination will continue (e.g., indemnities, confidentiality).

13. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of courts in Mumbai, India, subject to mandatory local dispute resolution procedures where required.

14. Changes to Terms

We may modify these Terms from time to time. Material changes will be posted on the Platform and, where appropriate, notified to account holders. Continued use after changes constitutes acceptance.
